1. Introduction

This Privacy Policy ("Policy") explains how Fanify Technologies Private Limited, a company incorporated under the laws of India ("Dazzo", "we", "us", or "our"), collects, uses, stores, shares, and protects personal data of users of the Dazzo platform, including our website, mobile applications, and related services (collectively, the "Platform").

Dazzo is a creator commerce platform that connects social media creators with brands and businesses across categories, enabling creators to monetise their influence through affiliate links, brand collaborations, and performance-based payouts, supported by our analytics layer, dazzIQ.

This Policy applies to creators, brands, business users, visitors, and any other individual who accesses or uses the Platform (collectively, "you" or "users"). By accessing or using the Platform, you agree to the collection and use of information in accordance with this Policy. If you do not agree with any part of this Policy, please do not use the Platform.

This Policy is published in accordance with the Digital Personal Data Protection Act, 2023 ("DPDP Act"), the Information Technology Act, 2000, the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and other applicable laws of India.

2. Scope and Applicability

This Policy applies to all personal data processed by us in connection with the Platform, regardless of whether it is provided directly by you, collected automatically, or received from third parties such as social media platforms, payment partners, or brand clients.

This Policy does not apply to information collected by any third party, including through any application or content that may link to or be accessible from the Platform, or to the practices of third parties that we do not own or control, including social media platforms you choose to connect to your Dazzo account.

3. Definitions

  • "Personal Data" means any data about an individual who is identifiable by or in relation to such data.
  • "Sensitive Personal Data" means personal data such as financial information, bank account details, and government-issued identification numbers that requires a higher standard of protection.
  • "Creator" means an individual user who uses the Platform to collaborate with brands, share affiliate links, or generate income through the Platform.
  • "Brand" or "Business User" means an entity or individual that uses the Platform to run campaigns, collaborate with creators, or purchase advertising and marketing services.
  • "dazzIQ" means the analytics and insights layer of the Platform that provides performance dashboards to creators and brands.
  • "Processing" means any operation performed on personal data, including collection, storage, use, disclosure, and deletion.

4. Information We Collect

We collect information that you provide to us directly, information generated through your use of the Platform, and information received from trusted third parties, as summarised below.

Providing certain categories of data, particularly KYC and payout details, is mandatory for creators who wish to receive payments through the Platform. Where such data is not provided, we may be unable to process payouts.

5. How We Use Your Information

We use the personal data we collect for the following purposes:

  • To create and manage your Dazzo account and verify your identity as a creator or brand user.
  • To match creators with relevant brand campaigns based on follower count, niche, engagement, and audience demographics.
  • To process payouts, commissions, invoices, and other financial transactions, including verification through our payment and KYC partners.
  • To operate and improve dazzIQ, including generating performance dashboards and campaign insights for creators and brands.
  • To communicate with you regarding campaigns, payments, platform updates, service notices, and promotional offers, where permitted.
  • To monitor, detect, and prevent fraud, abuse, policy violations, and other unlawful activity on the Platform.
  • To comply with applicable legal, tax, and regulatory obligations, including responding to lawful requests from government or law enforcement authorities.
  • To conduct internal research, analytics, and product development to improve the Platform's features and user experience.

6. Legal Basis and Consent

We process your personal data on the basis of your consent, for the performance of our agreement with you (such as our Terms of Use), to comply with legal obligations, and for other legitimate uses permitted under the DPDP Act, such as processing that is voluntarily provided and necessary for a purpose you have specifically requested.

Where processing is based on consent, you may withdraw such consent at any time by writing to our Grievance Officer at the contact details provided in Section 15. Withdrawal of consent will not affect the lawfulness of processing carried out prior to withdrawal, and may result in our inability to continue providing certain features of the Platform, such as payouts or campaign matching.

7. Sharing and Disclosure of Information

We do not sell your personal data. We may share your information with the following categories of recipients, only as necessary to operate the Platform:

  • Brands and business users, where you choose to participate in a campaign, so that they can evaluate your profile and coordinate collaborations.
  • Payment gateways, banking partners, and KYC verification providers, to process payouts, verify identity, and comply with financial regulations.
  • Cloud hosting, analytics, and customer support service providers who process data on our behalf under contractual confidentiality obligations.
  • Social media platforms and APIs that you choose to connect to your Dazzo account, to the extent necessary to retrieve performance metrics.
  • Professional advisors, including auditors, legal counsel, and consultants, on a need-to-know basis.
  • Government authorities, regulators, or law enforcement agencies, where required by applicable law, court order, or to protect our rights, users, or the public.
  • A successor entity in connection with a merger, acquisition, restructuring, or sale of assets, subject to equivalent confidentiality protections.

We require all third parties with whom we share personal data to implement appropriate safeguards and to process such data solely for the purposes for which it was shared.

8. Cookies and Tracking Technologies

The Platform uses cookies, web beacons, and similar tracking technologies to recognise you, remember your preferences, understand how the Platform is used, and improve your experience.

  • Essential Cookies: Necessary for the Platform to function, such as maintaining your login session.
  • Performance Cookies: Help us understand how users interact with the Platform so we can improve it, including through dazzIQ analytics.
  • Functional Cookies: Remember your preferences, such as language or display settings.
  • Advertising Cookies: Used to measure the effectiveness of campaigns and, where applicable, to serve relevant promotional content.

You can control or disable cookies through your browser or device settings; however, doing so may affect the availability or functionality of certain features of the Platform.

9. Data Storage, Security, and Retention

We implement reasonable technical and organisational security practices and procedures, including encryption of sensitive personal data in transit and at rest, access controls, and periodic security reviews, in line with the standards prescribed under the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011.

Your personal data is primarily stored on secure servers located in India or with cloud service providers that maintain equivalent security certifications. We retain personal data only for as long as necessary to fulfil the purposes described in this Policy, to comply with our legal, accounting, or reporting obligations, or to resolve disputes.

Where you close your Dazzo account, we will delete or anonymise your personal data within a reasonable period, except where retention is required for legal, regulatory, tax, or dispute-resolution purposes, such as maintaining transaction and payout records.

10. Your Rights

Subject to applicable law, you have the following rights in relation to your personal data:

To exercise any of these rights, please contact our Grievance Officer using the details in Section 15. We may need to verify your identity before acting on your request, and we will respond within the timelines prescribed under applicable law.

11. Children's Privacy

The Platform is intended for use by individuals who are at least 18 years of age or who have attained the age of majority under applicable law. We do not knowingly collect personal data from children. If we become aware that we have inadvertently collected personal data from a child without verifiable parental or guardian consent, we will take steps to delete such data promptly.

12. Third-Party Links and Integrations

The Platform may contain links to, or integrations with, third-party websites, applications, or services, including social media platforms and brand websites. This Policy does not apply to such third-party services, and we encourage you to review their respective privacy policies before sharing any personal data with them.

13. Cross-Border Data Transfers

Where any of our service providers, such as cloud hosting or analytics partners, are located outside India, your personal data may be transferred to and processed in such jurisdictions, subject to safeguards consistent with the DPDP Act and other applicable data protection laws, and in compliance with any restrictions on cross-border transfer notified by the Central Government from time to time.

14. Data Breach Notification

In the event of a personal data breach that is likely to affect you, we will notify the Data Protection Board of India and affected users in the manner and within the timelines prescribed under the DPDP Act and its rules, and will take reasonable steps to mitigate any harm arising from such breach.

15. Grievance Officer and Contact Details

In accordance with the DPDP Act and the Information Technology Act, 2000, we have appointed a Grievance Officer to address your queries, concerns, and complaints regarding this Policy or the processing of your personal data.

16. Changes to this Policy

We may update this Policy from time to time to reflect changes in our practices, technology, legal requirements, or other operational reasons. We will notify you of material changes through the Platform or by email, and will update the "Last Updated" date at the top of this Policy. Your continued use of the Platform after any changes take effect constitutes your acceptance of the revised Policy.

17. Governing Law and Jurisdiction

This Policy shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with this Policy shall be subject to the exclusive jurisdiction of the competent courts located in Delhi, India, without prejudice to any rights you may have to approach the Data Protection Board of India or other competent authority.
